Health care providers who are
residents of Kansas obtain the basic professional liability
insurance from an authorized insurance company. If you can
not locate this coverage by contacting insurance agents in
your locality, you may wish to contact your Kansas
professional association or society
(e.g., Kansas Chiropractic Association, Kansas Medical
Society, etc.), the Kansas
Insurance Department or the
Compliance Section of the Health Care Stabilization
Fund.

should assist you and your basic professional liability
insurance company with understanding the Fund surcharge
rating classification system. It is the responsibility of
the insurance company which provides the basic professional
liability insurance to accurately classify and apply the
correct Fund surcharge rate for Kansas resident health care
providers.
"Resident"
means a defined health care provider who by general legal
principles is a resident of the state of Kansas. There
are no specific definitions of this term in the Fund law.
The coverage of the Fund "follows" the resident health care
provider outside of Kansas where such resident health care
provider is authorized (licensed, etc.) to practice.
Resident health care providers who practice outside of
Kansas should advise their professional liability insurer of
those non-Kansas practice locations to avoid any basic
professional liability insurance problem
areas.
KANSAS
RESIDENT HEALTH CARE PROVIDERS PRACTICING IN
MISSOURI -- For FY 2008 an additional surcharge amount equal
to 25% of the surcharge shall be added to the surcharge
payment of the Kansas resident health care provider who is
licensed (registered, etc.) and rendering professional services in
Missouri. (Prior to FY2008 the additional Missouri surcharge rate
was 20%.) The Missouri practice modification factor is applicable to all Fund
