Why have some thing like the Health Care Stabilization Fund?

One of the primary objectives of the Fund is to assure health care providers that there will be reasonable professional liability coverage available within the state of Kansas. The Fund law assures this by establishing an availability plan for the required basic $200,000/$600,000 professional liability insurance and Fund for excess professional liability coverage up to $800,000/$2,400,000.

The Fund also provides many professional liability coverage areas that the private insurance market does not afford. For example:

  • The "tail" coverage provided to eligible inactive health care providers has among other features significant fiscal year coverage limits which are broader coverage provisions than what is offered by insurers.
  • Also, the Fund supports a basic professional liability insurance coverage program without financial assistance from insurers.
  • Another beneficial aspect of the Fund is that all surcharge revenue and income derived from the investment of the balance of the Fund remain in the special State of Kansas accounts.

Because the Fund is authorized by Kansas law, only the Kansas legislature can change the coverage and operational provisions of the Fund.
