Basic Professional Liability Insurance Coverage Information For Kansas Health Care Providers
 

The following list includes the insurance companies and markets that have been submitting Notice of Basic Coverage documentation and surcharge payments.  When possible, we are continuing to provide the insurer contact information for each of these insurance markets.

The Health Care Provider Insurance Availability Plan will provide basic coverage for any class of Kansas health care provider. The Availability Plan is intended to be the "market of last resort", requiring health care providers who seek coverage from the Availability Plan to provide evidence that they have been declined by voluntary insurance companies. Health care providers insured by the Availability Plan pay a higher basic coverage premium and surcharge than if the health care provider had been insured by on of the voluntary insurance companies.  If you are unable to obtain the required basic professional liability insurance coverage from one of the voluntary insurance companies, the Health Care Provider Insurance Availability Plan will be able to assist you.

When changing insurance companies, please carefully review any differences in the policy coverage  provisions (including conditions and exclusions),  between your current and new policy form.  There is additional information about some of the possible problems in the April 2004 newsletter of the Fund.  If you wish to read that article, click here.

If you do change insurance companies and have any reason to feel uncertain about the new insurance company providing the necessary coverage information and surcharge payment to the Health Care Stabilization Fund, please contact the Fund for assistance.  There have been situations that resulted in late or missing coverage documents and surcharge payments for health care providers who changed their basic professional liability insurance company.

All insurance companies included in the above list have been authorized by the Insurance Commissioner to issue basic professional liability coverage to Kansas resident doctors, hospitals and other health care providers who participate in the Fund.

Except for the five Risk Retention Groups (RRG*), the policyholders of each of the above insurance companies are specifically protected by the Kansas Insurance Guaranty Association Act. The purpose of the Kansas Insurance Guaranty Association Act is to protect Kansas policyholders should their insurance company become insolvent (subject to the provisions of the Kansas Insurance Guaranty Association Act).  (Risk Retention Groups (RRGs) are required by Kansas law to include the following statement on the front page of any policy issued in Kansas: This policy is issued by your risk retention group. Your risk retention group may not be subject to all of the insurance laws and regulations of your state. State insurance insolvency guaranty funds are not available for your risk retention group.)

There are several types of insurance companies that are affording basic professional liability insurance coverage to Kansas health care providers. If you have any questions or concerns regarding the insurance company or RRG you have selected or from which you are considering to purchase your professional liability insurance coverage, you should contact the Fire and Casualty Division of the Kansas Insurance Department (785-296-3071).
