Information for health
care providers who have been called up for temporary active
military duty:
1. SPECIAL TEMPORARY EXEMPTION
AVAILABLE: If you have been complying with the Fund for less
than five years, you may submit an application to the Fund
Board of Governors to become eligible for Fund tail coverage
during the time you are on temporary active duty. If your
request is approved by the Board of Governors, the Fund tail
coverage limits that you have selected will be applicable
during this period of time. For the Fund temporary
exemption, please follow these instructions:
A. Download the necessary
application and affidavit forms: These forms are on pages 6

Alternate methods of
obtaining the application and affidavit forms from our office:
1) Send a request for the
application and affidavit forms by e-mail.
2) Fax a request to the Fund office. Our fax number is
785-291-3550.
3) Send a request for the application and affidavit
forms by mail.
4) Call our office (785-291-3777) and request the forms be sent
to you by fax or by mail.
B. Contact your professional
liability insurance agent or company representative and
request the termination or other modification of your basic coverage for the
period of your temporary military service. Only the
applicable Fund coverage
limits will be available during this
period of time. The Fund coverage limits will be
applicable to your professional services rendered while you were
maintaining the basic professional liability coverage and will not
be available for your professional services rendered while on
temporary active duty.* You should
discuss this matter carefully with your insurance agent
or company representative and also review any other
excess professional liability coverage you may have in
effect.
(When necessary, the Fund may contact
your basic professional liability insurer to obtain information
about the termination or other modification (e.g., suspension of
coverage for professional services rendered while on temporary
active duty) of your basic coverage.)*
C. Complete and return the
application and affidavit forms by fax
or mail.
2. If you have been complying with the
Fund for more than five years, you may cancel your current
basic professional liability insurance coverage and your
Health Care Stabilization Fund coverage. The Health Care
Stabilization Fund will provide its tail coverage during the
time you are on temporary active duty. Only the
applicable Fund coverage
limits will be available during this
period of time. You should review your professional
liability coverage limits carefully with your agent or
insurance company representative and also review any other
excess professional liability coverage you may have in
effect. If this is your situation,
please contact the Fund for assistance with any questions
you may have or if you should need additional information
for your personal records.
3. For health care providers who
terminate their basic professional liability insurance
coverage and are eligible for the Fund tail coverage while
on temporary active military duty, the Fund will return any
unearned portion of the previously paid Fund surcharge. We
will furnish the necessary refund request forms when
contacted regarding the availability of Fund tail coverage
for the period of your temporary military service.
4. If you have been complying with the
Fund while engaged in a postgraduate training program, the
Health Care Stabilization Fund will provide its tail
coverage during the time you are on temporary active duty.
The Fund tail coverage limits that you have selected will be
applicable during this period of time. If this is your
situation, please contact the Fund for assistance with any
questions you may have or if you need additional information
for your personal records.
Other information: If you have
been given the power of attorney for a health care provider
who has been called to temporary active military duty,
please contact the Fund and we will assist you in these
matters or provide additional information.
We will make every attempt to promptly
respond to each inquiry, request for temporary exemption or
confirmation of Fund tail coverage during the period a
health care provider may be called to temporary active
military duty.
Other actions you may wish to consider: Contact your licensing agency to determine any
action they may wish you to take with regard to your being
called into temporary active military duty.
You may wish to contact your
professional liability insurer asking for their advice
and
assistance with regard to your professional liability
insurance coverage arrangements.
